General Terms and Conditions of the Match Table Platform ('General Terms and Conditions')

1. Scope of application of these General Terms and Conditions Match Table , ('we' or 'us') operates a platform under the URL https://www.matchtable.eig.gg/ through which gamers can participate in cups, tournaments and leagues in various tabletop games ('Platform'). To participate, the respective gamers can register ('Users') by creating user accounts. We make the respective cups, tournaments and leagues in various tabletop games, as well as live tournaments ('Events') accessible via our Platform. In the future, Events on the Platform can also be organized and carried out independently by third parties or commission us to organize and carry out such Events ('Organizers').

2. Our services 2.1 We will regularly organize Events in various tabletop games via the Platform. For this purpose, we will create an event schedule, a tournament tree, provide the technical infrastructure for the registration of Users for an Event and the tracking of the respective Event results. We do not provide any other services beyond this content that can be accessed via our Platform. The implementation and hosting of the game operation itself is not our responsibility, but the responsibility of the respective Users or the Organizers.

2.2 Participation in Events requires a valid license for the respective tabletop game of the User. We ourselves do not provide the necessary game license or server infrastructure, nor do we act as host of the individual Events. The User is responsible for acquiring this license. We merely provide a Platform for planning and evaluating the Events and bring interested gamers together.

2.3 Likewise, the User acknowledges that he/she is responsible for the functioning of the hardware necessary for participation in an Event and for compliance with the respective system requirements of the respective tabletop game. Third-party services (such as Internet access) may be required to participate in an Event and to use the respective tabletop game.

2.4 We provide our Platform only in its current version. The Users have no claim to the maintenance or establishment of a certain condition or a certain scope of services.

2.5 We do not undertake any responsibility and give no guarantee or other assurance for a specific availability of our Platform, its quality, suitability, completeness or the correctness of information on it. Claims against us in connection with loss of use, malfunctions, etc. are excluded. We reserve the right to interrupt or prematurely terminate Events at any time and without prior notice. We are particularly entitled to do this if the proper execution of the Event can no longer be guaranteed for technical, legal or economic reasons and/or does not appear to be reasonable. We further reserve the right to restrict access to our Platform insofar as this is required for the security of our Platform and/or the Users' data. This does not affect our liability under clause 12.

3. Registration as a User 3.1 Use of the Platform requires registration as a User and creation of an account, which is free of charge.

3.2 In principle, registration as a User of the Platform for minors - this means persons under the age of 18 (hereinafter 'minor') – is not excluded. However, the registration of underage persons always requires the consent of his or her legal guardian. However, we point out that the minimum age for individual Events is determined by the individual Rules and that the participation of underage persons may be completely excluded. The Organizers are also responsible for the admission of Users within the framework of the age classification of the Entertainment Software Self-Regulation Body (USK) for the respective Event.

3.3 The data requested by us during registration must be provided completely and correctly and must be kept up to date at all times. At our sole discretion, we may verify the accuracy of the data provided during registration, but we cannot fully verify the identities of registered Users. Despite our security precautions, it is therefore possible that incorrect contact details were entered during registration or that these are no longer up to date. The Users themselves are responsible for the correctness of the data provided.

3.4 Upon completion of the data entry pursuant to clause 3.3 of these General Terms and Conditions, you will receive an activation email from us to confirm the content and submission of your offer. This activation email contains an activation link.

3.5 We accept this legally binding offer with a confirmation message via e-mail and the registration is thereby completed. With the registration, a contract of use is concluded between us and the User - in the case of minors, with the consent of the legal guardian. There is no entitlement to the conclusion of a User contract. Upon completion of registration, the User's account is activated.

3.6 A User may only register for one account. Registration for several accounts is expressly prohibited. This provision constitutes a material obligation on the part of the User.

3.7 Our Platform is addressed exclusively to consumers within the meaning of § 13 BGB. A consumer is any natural person who enters into a legal transaction for a purpose that is neither commercial nor self-employed.

3.8 The text of the contract (consisting of the General Terms and Conditions and confirmation message) is sent to the User on a durable medium (e-mail or PDF) at the latest with the confirmation message (contract confirmation). We do not store the text of the contract.

4. The Usage of the Platform 4.1 Users may - subject to deviating Rules of individual Events - participate in all Events and otherwise use our Platform to the full extent, as well as receive prize money.

4.2 The General Terms and Conditions are concluded for an unlimited period of time.

5. Prize money 5.1 Users can win the prize money described in the respective Rules for an Event.

5.2 If a User who is a minor has won prize money in accordance with the respective Rules for an Event, the prize money will only be paid out to the respective legal guardian and to their bank account.

5.3 The User or Users who have won prize money in accordance with the respective Rules of an Event will be notified by us of the respective prize money by e-mail within two (2) weeks after the end of the respective Event. This notification will also contain the further modalities of payment. The prize money and the conditions of participation are specified in more detail in the respective Rules to which the User has agreed in advance of an Event.

5.4 No notification shall be made or the entitlement to receive the prize money shall lapse if the respective prize money is subject to an age limit specified in accordance with the respective Rules under the applicable youth protection regulations and the User has not reached this age limit, the User violates the provisions of these General Terms and Conditions or the rules and regulations of an Event as defined in section 6.5.

5.5 The right to receive the prize money shall also lapse if the respective User does not contact us within fourteen (14) days after being notified and confirms receipt of the prize money, and/or the respective User cannot be reached under his or her stated data. In such cases, we reserve the right to notify the next placed User and to award the prize money to that User. Prize money and participation rights are not transferable. The risk of accidental loss of the prize money shall be borne by the User. Legal recourse with regard to the implementation of Events and the receipt of prize money is excluded.

6. Obligations of the User 6.1 The User assures that he/she does not pursue any commercial and/or business intentions in connection with his/her account and in this respect undertakes not to use our Platform for commercial or business purposes. The User is not entitled to use the Platform to advertise commercial activities unless we agree to this in writing in advance.

6.2 The account and the User relationship are limited to natural persons acting privately, are of a highly personal nature and are not transferable to other persons. The same applies to participation in all Events. When registering the account or registering for an Event, the User's corresponding account for the gaming platform on which the Event is based must also be specified. Only the User himself/herself may participate in the Events with the specified account. In the Event of a breach of this clause, we shall have an immediate, extraordinary right of termination and the User may be excluded from all Events.

6.3 Furthermore, the following rules against improper use apply to the User in connection with his use of our Platform: The User will not disseminate any defamatory, offensive, pornographic, obscene, politically radical or otherwise illegal material or information via our Platform; The User will not use our Platform to threaten or harass other Users or to violate the rights (including personal rights) of third parties; The User will not upload any data via our Platform that contain viruses (infected software) or otherwise affect, impair or damage our systems or are capable of doing so. The User will not upload via our Platform any software or other material that is protected by copyright unless the User has the rights thereto or the necessary releases; The User will not use our Platform in a way that adversely affects the availability of the offers for other Users; The User will not use any applications or measures of any kind whatsoever that make it possible to influence the score or the course of the game. This includes in particular the use of cheats, bots, hacks, software tampering or other manipulation of the course of the game; The User shall not take or attempt to take any action to modify, delete, extract, analyze or alter any content of the Platform. This includes, in particular, any attempts to decrypt and influence the source code of the Platform; The User will not intercept or attempt to intercept any emails through our Platform; The User will not advertise for other, non-commercial portals via our Platform; The User will not send chain letters via our Platform; The User will not disclose login information and personal passwords to third parties or share them with third parties; The User will not use the Platform in a way that violates applicable laws. 6.4 The User acknowledges that a violation of one or more of the aforementioned rules or the Rules of the individual Events within the meaning of section 6.5 may lead to immediate termination of these General Terms and Conditions and/or respective participation agreements, as well as exclusion from ongoing and future Events, and may have civil and criminal consequences for the User himself/herself. We will assign designated persons to monitor compliance with these General Terms and Conditions as well as applicable rules and regulations ('Admin'). Admins have the right to independently impose any sanctions set forth in the Rules and these General Terms and Conditions on our behalf in the event of a relevant violation and will report all violations to us. In particular, we reserve the right to exclude the User from our Platform if, in our opinion, immoral, obscene or politically radical content or photos are disseminated during registration or use of the Platform.

6.5 In addition to these basic rules of conduct, special additional or deviating rules and/or conditions of participation ('Rules') may apply to individual Events. These will be displayed to the User when registering for an Event. Registration for an Event implies confirmation and agreement to the respective set of rules. In the Event of contradictions between these General Terms and Conditions and the respective set of rules, the respective set of rules shall take precedence to the extent necessary to resolve the contradiction.

7. Termination of the contract of use 7.1 These General Terms and Conditions can be terminated at any time in text form. The User can view our contact information under 'Contact' on our website.

7.2 The right to extraordinary termination of these General Terms and Conditions shall always remain unaffected for both parties. An important reason entitling us to extraordinary termination exists in particular if the User violates provisions of these General Terms and Conditions and/or the Rules.

8. Granting of rights 8.1 The User grants us a non-exclusive right, not limited in terms of space, time or content, to use the content created and posted by him/her during the use of the Platform, including images, texts and tabletops as well as the results of the respective Events, for the purpose of operating our Platform. If the User is a minor, the legal guardian shall grant the corresponding consent to the granting of rights by agreeing to these General Terms and Conditions. This granting of rights expressly does not include the right to advertise our Platform or services. In particular, this also includes a permission under personal rights with regard to the aforementioned materials.

8.2 The User assures that the content created and posted by him during registration on the Platform and during registration and participation in an Event and the use thereof within the scope of the aforementioned granting of rights do not infringe copyrights or other rights of third parties or other rights. In this respect, the User assures that he/she does not post any photographs or other works within the framework of the use of the Platform without being entitled to do so in accordance with the relevant copyright regulations.

9. Indemnification The User shall indemnify us against all claims, disputes, demands, liabilities, damages, losses, costs and expenses arising out of or in connection with claims that (i) the User breaches the obligations incumbent upon him under these General Terms and Conditions, in particular obligations under clause 6, or that (ii) content which the User provides or uploads with or to our Platform infringes the rights of third parties and that in each case this is due at least to negligence on the part of the User.

10. Notice of rights We are the sole owner of all rights, or, in the case of third party rights, have acquired the corresponding licenses, to the software underlying our Platform and to the underlying system, including in particular copyrights, trademark rights, trade secrets, intellectual property and all other rights. If the Platform contains third-party content, such as logos, graphics, trademarks or photos of third parties, the respective rights of use are held by the respective third party and have been licensed by us.

11. Data protection The operation of the Platform is subject to our data protection information, which the User can access via our website and here https://Match Table.gg/quicklinks/privacy-policy.

13. Liability 12.1 Claims for damages by the User are excluded. Excluded from this are claims for damages by the User arising from injury to life, limb or health or from the breach of essential contractual obligations (Kardinalspflichten) as well as liability for other damages based on an intentional or grossly negligent breach of duty by us or our respective legal representatives or vicarious agents. Material contractual obligations are those whose fulfilment is necessary to achieve the objective of this agreement.

12.2 In the Event of a breach of essential contractual obligations, we shall only be liable for the foreseeable damage typical for the agreement if such damage was caused by simple negligence, unless the User's claims for damages are based on injury to life, body or health.

12.3 The restrictions of clauses 12.1 and 12.2 shall also apply in favor of our legal representatives, employees and vicarious agents if claims are asserted directly against them.

12.4 The limitations of liability resulting from clauses 12.1 and 12.2 shall not apply insofar as we have fraudulently concealed the defect or have assumed a guarantee for the quality of the item. The same shall apply insofar as the User and we have reached an agreement on the quality of the item. The provisions of the Product Liability Act (Produkthaftungsgesetz) shall also remain unaffected.

13. Changes to the General Terms and Conditions or the services 13.1 We are entitled to amend these General Terms and Conditions. We will inform the User of this in good time before the changes come into force via the contact options provided by the User.

13.2 If the User does not object within the period specified in this notice, or if the User continues to use our Platform after the time of entry into force of the changes specified in the notice, this shall be deemed as consent to the changes. We will specifically draw the User's attention to this consequence in the notification.

14. Final Provisions, Online Dispute Resolution 14.1 The European Commission provides a Platform for online dispute resolution. This Platform can be accessed via the external link https://www.ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.

14.2 Subject to the rules and regulations, as well as the General Terms and Conditions of the Platform, no ancillary agreements have been made. Should any provision of these General Terms and Conditions be or become invalid, the remaining part of the General Terms and Conditions shall otherwise remain valid. In all other respects, the relevant statutory provisions shall apply in place of the invalid provision.

14.3 The law of the Federal Republic of Germany shall apply, under the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). If the User is a consumer and has his habitual residence in another country at the time of conclusion of the contract of use, the application of mandatory legal provisions of that country shall remain unaffected by the choice of law made in sentence 1. As far as permissible, all legal disputes regarding the usage relationship shall be settled before the competent courts in Schwabach. Regarding any disputes arising out of these General Terms and Conditions, the German language version the General Terms and Conditions shall govern in case of a contradiction between the interpretation of the different language versions.
